PREAMBLE

These Terms of Use ("Terms") govern Your use of Mojo’s Service.

  1. LEGAL INFORMATION AND CONTACTService Publisher

The Mojo Service is currently available in 35 languages, including but NOT limited to English, French, Spanish.

  1. DEFINITIONS

The following terms have the meanings set forth below:

"Account": Your personal space created when You register on Mojo.

“Affiliates”: any present or future entity that, directly or indirectly, controls, is controlled by, or is under common control with Dailymotion Inc. This includes parent companies, subsidiaries and sister companies. “Consumer”: an individual acting for purposes outside their trade, business, craft, or profession (i.e. for personal, non-commercial use). If You subscribe to the Service for business or commercial purposes, there may be some rights like the right of withdrawal (see 7) that do not apply to You.

“Credits”: virtual units of consumption required to access and use certain AI-powered features within the application. Each Credit entitles You to generate one (1) AI-powered creation (including but not limited to AI-generated images, videos, effects, or other content produced through artificial intelligence tools). For more, see 6.9.

"Mojo Content": all elements provided by Mojo, including templates, effects, filters, fonts, music, and interface.

"Mojo Free": a free-of-charge version of the Service with limited features.

"Mojo Pro": paying monthly or annual subscription providing access to advanced features, as part of

Mojo’s Paid Plans as further described in Section 5. 2.

"Mojo Pro AI": paid monthly or annual subscription including Mojo Pro features and artificial intelligence tools

“Paid Plans”: paid subscriptions, which may refer to the Mojo Pro subscription or the Mojo Pro AI subscription.

"Terms" or "Terms of Use": this document.

"Privacy Policy": document detailing the processing of Your personal data, available from our website or application at all times.

“Prompt”: text or media input provided by You to AI-powered features to generate User content. "Service": the Mojo mobile application (available on iOS and Android) and web version, and more generally, any Mojo products, software, data feeds, services and functionalities, as accessible via any current or future device capable of distributing the Service.

"User Content": any content (video, image, text, etc.) that You create, import, or publish via the Service, including your inputs (such as Prompts, uploaded images, videos, text) and outputs (such as final videos created via any of Mojo's AI-generating tools and features, excl).

"You" or "User": any individual or legal entity using the Service.

"We" or "Mojo": Dailymotion Inc., the publisher of the Service.

  1. ACCEPTANCE AND AMENDMENT OF TERMSAcceptance of Terms

By creating an account, subscribing to any paid plan, or using the service in any manner, you expressly acknowledge that:

  1. You have read these Terms, our Privacy Policy, and Cookie Policy in full;
  2. You understand and accept all provisions contained therein;
  3. You agree to be legally bound these Terms;

If You do not accept these Terms unconditionally, You must immediately cease all use of the Service and refrain from creating an Account or subscribing to any plan.

  1. Access to and Preservation of the Contract

In accordance with applicable regulations, we guarantee Your ability to:

  • Access these Terms at any time (both logged in and logged out) via the app’s settings or on our website;
  • Download, print, or save them for preservation during and after the term of Your subscription.
  1. Amendments to Terms

We may amend or update these Terms from time to time to reflect changes, updates, or new features to the Service, or when there are regulatory or legal changes.

We will use commercially reasonable efforts to notify you of any material changes to these Terms, such as through a notice in the application or by email. You should check such notices and review these Terms regularly to stay informed.

Each time we update these Terms, we will also update the "Effective Date" at the top of this document. The "Effective Date" reflects the effective date of the updated Terms.

Your continued access to or use of the Service after the effective date of the updated Terms constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop accessing or using the Service and cancel your subscription (if applicable) in accordance with Section 6.3.

The current version of these Terms is always accessible in the application and on our website.

  1. ELIGIBILITY AND ACCOUNT CREATIONMinimum Age

To use Mojo’s Service, You must be at least 15 years old. For users residing outside the European Union, the minimum age may vary according to Your local legislation. You agree to comply with the legal age applicable in Your country of residence.

If You are between 15 and 18 years old, please not that:

  1. You declare that You have obtained authorization from Your parents or legal guardian before creating an account;
  2. By creating an Account, You represent and warrant that such consent has been obtained;
  3. We may request proof of parental consent or age verification document at any time. Failure to provide such proof or document may result in immediate suspension or termination.

Parents and legal guardians are responsible for supervising minors’ use of the Service and any purchase

made through the Account.

  1. Account Creation and Security

To access the Services, You must create an Account by providing a valid email address and a secure password.

You may also create an Account via Apple Sign-In or Google Sign-In.

Your information must be accurate, complete, and up to date. Providing false or misleading information constitutes a violation of these Terms and may result in suspension or termination of Your Account.

You are responsible for the security of Your Account, including:

  • Choosing a strong password;
  • Maintaining confidentiality of Your credentials;
  • All activities performed under Your Account;
  • Not sharing Your Account credentials with any third party.

If You detect unauthorized use of Your Account, You must immediately notify us by clicking "contact us" in the website footer.

We cannot be held liable for consequences of fraudulent use of Your credentials if You have not taken necessary precautions.

If You are not an individual (i.e. a corporation or other legal entity), You represent to Mojo that You have all necessary corporate or equivalent authority and power to agree to these Terms, which shall be binding on the corporation, partnership, association, or other entity in whose name You are using or accessing the Service.

Access to the Service is limited to individuals, corporations, or other legal entities. Access by means of automated processes (e.g. robots, botnets, scrapers) is expressly prohibited without the prior written approval of Mojo. Mojo may use technical means to detect and block any unauthorized automated access to the Service.

  1. DESCRIPTION OF SERVICESGeneral Overview

Mojo is a mobile video Content creation application that, depending on your subscription plan, may allow You to:

  • Create professional animated videos for Your social networks
  • Use ready-to-use templates
  • Add effects, filters, animations, and transitions
  • Integrate licensed music
  • Use various fonts
  • Export Your creations in different formats and resolutions
  • Share directly on social networks

Please note that the features and User Content available on Mojo may also vary depending on your country's location and/or the device you use to access the Service.

  1. Subscription Plans

FREE PLAN: Basic free-of-charge access with limited templates, effects, and music. HD export with watermark.

PAID PLANS:

  • Mojo Pro: Full access to all features, unlimited watermark-free exports, 4K resolution, premium content library, and priority support. Mojo Pro AI (iOS only) includes additional artificial intelligence tools.

  1. Free Trial Period

When You first subscribe to a Paid Plan, You may benefit from a free trial period.

Trial conditions:

  • One trial per User (detection by account, email, and device);
  • Full access to features of the chosen plan;
  • Automatic start of your paid subscription at the end of trial period, unless cancelled before expiry;
  • Cancellation possible at any time during trial without any charge;
  • The free trial period associated to the Mojo PRO IA Plan will grant You a certain number of Credits that will allow you to try and explore the functionalities that Mojo offers.
  1. Generative AI Features

The Mojo Pro AI Plan includes features powered by artificial intelligence. By using these features, You acknowledge and agree that:

  1. No Exclusivity: AI-generated User Content is not unique. Other users may generate identical or similar content using similar prompts;
  2. Accuracy: AI may occasionally produce incorrect, offensive, or biased User Content that does not represent Mojo’s views. You are solely responsible for reviewing and verifying any AI-generated User Content before sharing or publishing it;
  3. Input Responsibility: You are responsible for the text or media input You provide. You must not use Prompts that violate third-party rights or these Terms.
  4. PAID PLANS SUBSCRIPTIONSSubscription Purchase

You can subscribe to a Paid Plan via:

  • Our website via this link
  • On iOS: App Store (Apple) → Billing via Your Apple ID / iTunes Account
  • On Android: Google Play Store → Billing via Your Google Account

By subscribing, You acknowledge having read the right of withdrawal (see Section 7).

  1. Automatic Renewal

IMPORTANT: Your subscription automatically renews at each expiry (monthly or annual) unless You cancel it before the renewal date.

How it works:

  1. At the end of Your subscription period (example: 30 days after subscription for a monthly subscription), Your subscription automatically renews for an identical period
  2. The amount is charged to Your registered payment method
  3. You receive a renewal notification email 7 days in advance
  4. Subscription Cancellation

You may cancel Your subscription at any time. Cancellation takes effect at the end of the current period. Need   help   with   the   cancellation   procedure?   Visit   our   Help   Center. Or contact us: feedback@mojo.video

After cancellation:

  • You retain access to Pro features until the end of Your paid period
  • At expiry, Your Account automatically switches to Mojo Free
  • Your creations remain accessible, but future exports will include the Mojo watermark
  1. Refunds

GENERAL PRINCIPLE: Subscriptions are non-refundable except as expressly provided below or as required by applicable consumer protection laws.

Exceptions (refunds granted at Mojo’s sole discretion):

  1. Material Service malfunction: if a proven technical defect prevents normal use of core features for more that 72 consecutive hours and You have contacted Mojo’s support within 7 days of the issue arising, You may be entitled to a pro-rata for the affected period;

Excluded: minor bugs, cosmetic issues, incompatibility with outdated devices, or internet connectivity issue on Your end;

  1. Duplicate billing: If Your payment method is charged multiple times for the same subscription period due to a technical error, the duplicate charge will be fully refunded;
  2. Unauthorized charges: If You can prove that a charge was made without Your authorization, and You notify us within 30 days of the charge, we will investigate and issue a refund if warranted.

To request a refund:

  1. Contact us at: feedback@mojo.video
  2. Provide Your name, Account email, subscription date, payment receipt, and detailed reason for request
  3. Attach supporting documents if applicable (screenshots of bugs, etc.)
  4. Review period: X business days

We reserve the right to refuse refund requests if we detect abuse patterns, including:

  • Repeated subscription/cancellation cycles to obtain free service;
  • Excessive commercial use followed by immediate cancellation;
  • Creation of multiple accounts to circumvent refund policies;
  • Clear evidence of fraudulent intent.

If We refuse Your refund request, we will provide a written explanation with supporting evidence. You may challenge this decision via our internal complaint system (see 13.7) or through applicable consumer protection channels.

App Store/Google Play subscriptions: Apple and Google apply their own refund policies. We cannot guarantee a refund through these platforms. However, You may submit a request directly to them:

Mojo has no control over Apple’s or Google’s refund decisions. Refund requests must comply with their

policies and timeframes.

Please not that You will continue to have access to the Services until your subscription payment is refunded by Apple or Google.

  1. Plan Modification

Upgrade (moving to a higher plan):

  • Possible at any time from the application
  • Immediate effect
  • Pro-rata adjustment for current period Downgrade (moving to a lower plan):
  • Takes effect at the end of current period
  • No refund of difference for current period
  1. Price Modifications

We reserve the right to modify subscription prices with minimum 30 days prior notice.

6.8 Credit System (for Mojo Pro AI plan only)

Credit Allocation:

  • Upon creating Your Account and only if you subscribe to the Mojo Pro AI Plan, You automatically receive two (2) complimentary Credits to test AI-powered features during the Trial Period ("Trial Credits"). Trial Credits are granted once per Account and cannot be restored if consumed.
  • Mojo Pro AI subscribers receive fifty (50) Credits per monthly subscription period, automatically credited at the start of each billing cycle.
  • Additional Credits may be purchased as Credit Packs. Credit Pack pricing, quantities, and validity periods are displayed at the time of purchase.

Each AI-powered User Content generation consumes one (1) Credit, regardless of the generation's quality, User satisfaction, or subsequent use of the generated User Content.

Expiration by type of Credits:

  • Trial Credits: Do not expire but are limited to two (2) per Account lifetime;
  • Monthly Subscription Credits: Expire at the end of each subscription period and do not carry over to subsequent periods;
  • Credit Pack Credits: Expire according to the validity period specified at purchase (typically 12 months from purchase date).

Credits are non-refundable once consumed. Unused Credits (excluding Trial Credits) are forfeited upon subscription cancellation or Account deletion, except as required by applicable consumer protection laws. Trial Credits are granted once per natural person. Creating multiple Accounts to obtain additional Trial Credits constitutes a violation of 13.1 and may result in Account suspension or termination without notice. Credits have no cash value and cannot be exchanged for money, transferred to other accounts, or sold to third parties.

We reserve the right to modify Credit allocation amounts, pricing, or consumption rates with thirty (30) days' prior notice to existing subscribers. Changes do not affect Credits already purchased or allocated before the modification date. Free Trial Credit allocation may be modified or discontinued at any time without prior notice.

If a technical error prevents User Content generation after Credit consumption, contact feedback@mojo.video within 7 with proof of the error for Credit restoration.

  1. RIGHT OF WITHDRAWALYour right to cancel

If You are a Consumer residing in the European Union, the European Economic Area, the United Kingdom, or any jurisdiction that provides for a legal right of withdrawal, You have the right to cancel your subscription and get a full refund within fourteen (14) days of purchase, for any reason, without penalty in accordance with the applicable laws.

The withdrawal period expires fourteen (14) days after the day on which the contract is concluded (i.e. the date of Your subscription purchase).

  1. How to Cancel

Send us a clear cancellation notice within 14 days to:

Subject: "Withdrawal - [Your Account Email]" Include: Your name, account email, and subscription date

We'll confirm receipt within 48 hours.

  1. Effects of Withdrawal

If You withdraw from Your subscription within the 14-day period:

  1. Refund: We will reimburse all payments received from You without undue delay and in any event no later than fourteen (14) days from the day on which We are informed of Your decision to

withdraw. We will use the same means of payment You used for the initial transaction, unless You have expressly agreed otherwise. In any event, You will not incur any fees as a result of the reimbursement.

  1. Service Access: Following Your withdrawal, Your access to Paid Plan features will be terminated. Your Account will revert to Mojo Free. Your User Content will remain accessible, but future exports will include the Mojo watermark.
  2. Credits: Any unused Credits allocated as part of Your subscription will be forfeited upon withdrawal. Credits already consumed before Your withdrawal request cannot be restored.
  3. App Store / Google Play Subscriptions

For subscriptions purchased via the App Store (Apple) or Google Play Store, Apple and Google apply their own refund policies in addition to these Terms. Please refer to Section 6.4 of these Terms.



  1. Users Outside the EU

Unless the laws of Your country provide for a right of withdrawal from digital services such as Mojo, the right of withdrawal described in this Section does not apply to You.

Regardless, You may cancel Your subscription at any time in accordance with Section 6.3 and benefit from the free trial period described in Section 5.3.

  1. LEGAL WARRANTIESLegal Warranty of Conformity for Digital Content and Services

In accordance with Articles L.224-25-12 et seq. of the French Consumer Code (transposing Directive (EU) 2019/770), if You are a consumer in France or the EU, we are required to provide You with a Service that is:

  1. Compliant with its description and possessing the presented qualities
  2. Suitable for the expected use of such a service
  3. Provided with necessary updates, including security updates
  4. Free from defects of conformity for a period of 2 years from continuous provision of the Service
  5. Warranty Against Hidden Defects

You also benefit from the warranty against hidden defects (Articles 1641 et seq. of the Civil Code), which may allow You to obtain a refund or price reduction if the Service has a hidden defect making it unsuitable for use.

  1. TERMINATION AND SUSPENSIONTermination by You

You are free to delete Your Account at any time, without reason, by following this procedure:

  • Via the application: Settings > Account > "Delete my account"
  • By email: Send a request to: feedback@mojo.video Indicate Your last name, first name, and the email address You used to create your account.

If You delete Your Account while You have an active Paid Plan subscription:

  • Your subscription will NOT be automatically cancelled. You must separately cancel Your subscription through the App Store, Google Play Store, or by contacting Mojo BEFORE deleting Your Account.
  • If You delete Your Account without cancelling Your subscription, charges will continue until You cancel directly with Apple or Google. Mojo is not responsible for charges incurred after Account deletion if You have not cancelled Your subscription.
  • No pro-rata refund will be granted for the remaining subscription period following voluntary Account deletion, except as required by applicable consumer protection laws.

We strongly recommend cancelling Your subscription FIRST (see Section 6.4), then deleting Your Account.

  1. Suspension or Termination by Mojo

We may temporarily suspend or permanently terminate Your Account in the following cases:

  1. Temporary Suspension

We may suspend Your Account in case of:

  • Suspected violation of these Terms (under verification)
  • Suspicious or fraudulent activity
  • Request from administrative or judicial authority
  • Need to protect security or integrity of the Service

9.2.2 Permanent Termination

We may permanently terminate Your Account without notice in case of:

  • Confirmed, serious or repeated violation of these Terms, including:
  • Publication of unlawful Content
  • Attack on Service security (hacking, malware, etc.)
  • Identity theft, fraud
  • Harassment or threats toward other users
  • Use of bots or unauthorized automation
  • Prolonged inactivity: If Your Account is inactive for 24 consecutive months, we may delete it after sending You 30 days' prior notice by email.

Notification and Remedies: In case of termination or suspension, we notify You by email or by in-app notification with precise reasons for the decision, legal basis.

9.2.3. Termination by Mojo for Other Reason

We may terminate these Terms with 3 months' notice in case of cessation of activity, Service closure, or technical, legal, or economic reasons making Service continuation impossible. In this case, pro-rata refund of Your current subscription.

  1. Effects of Termination and Data Retention

After Account termination (by You or by us), deletion of Your personal data within 30 days, in accordance with GDPR.

Retention possible for:

  • Legal obligations (accounting, fraud prevention): legal durations (e.g., 10 years for invoices)
  • Establishment, exercise, or defense of legal rights: until prescription of actions (generally 5 years)
  • Anonymized data for statistical purposes: unlimited retention (impossibility to re-identify you) See our Privacy Policy for more details on retention periods.
  1. YOUR USER CONTENT: RIGHTS AND LICENSESOwnership of Your User Content

You retain all intellectual property rights in Your User Content, to the extent such rights exist under applicable law. Mojo acquires no ownership rights in Your User Content.

For the avoidance of doubt:

  1. You own all original content You upload or create (photographs, text, videos, images);
  2. You own the final videos and creations You produce with Mojo as a whole and may freely use, export, publish, and commercially exploit them. However, the individual Mojo elements incorporated therein (templates, effects, music, filters) remain the property of Archery Inc. and/or its licensors and are licensed to You under Section 11.2;
  3. You have the right to use, export, modify, publish, and commercially exploit AI-generated content created through Your use of the Service. The extent to which such content may be protected by intellectual property rights depends on applicable law and the degree of Your creative contribution. Mojo does not claim any ownership of AI-generated content created at Your direction.
  4. License Granted to Mojo for Service Operation and Improvement

To operate and improve the Service, You grant Mojo and its Affiliates a worldwide, non-exclusive, royalty- free, sublicensable, transferable license to use Your User Content. This license is granted for the following purposes:

  1. Service operation: Hosting, reproducing, transcoding, modifying and backing Your User Content on our servers ; Displaying Your User Content as necessary to provide the Service to You ; Processing Your content through our editing tools, effects, and filters; Enabling You to export and share Your final videos.
  2. Service improvement and development (Innovation): Analyzing usage patterns and feature performance through anonymized and aggregated data ; Conducting internal research and development ; Training, testing, and improving artificial intelligence and machine learning models, algorithms, and technologies ; Developing new features, effects, filters, templates, and AI tools ;

Enhancing User Content recommendation systems ; Improving User Content moderation systems (e.g., detecting prohibited User Content) :

  1. Quality assurance and security: Detecting and preventing fraud, abuse, spam, and security threats; Investigating violations of these Terms; Complying with legal obligations (court orders, regulatory requests)

This license does NOT grant us the right to:

  • Sell Your User Content to third parties without your consent.
  • Use Your User Content for our external marketing without Your specific consent.
  • Publicly share Your private User Content without Your permission (except as required by law)
  1. License Termination

The license You grant us ends 30 days after You delete Your User Content or close Your Account (technical purging delay for servers and backups).

Exception: Please note that once You have exported and shared Your User Content on third party- platforms (social media, messaging apps...). We have no control over such exported copies. Your deletion request applies only to User Content stored on Mojo’s servers.

  1. Your Warranties and Responsibilities

By uploading, creating, or publishing User Content on or through the Service, You represent, warrant, and covenant to Mojo that:

  1. Ownership and Rights: You own all rights, title, and interest in Your User Content, OR You have obtained all necessary licenses, permissions, consents, and authorizations required to grant the license set forth in 10.2;
  2. No Infringement: Your User Content does not and will not:
  3. Infringe any third-party intellectual property rights (copyright, trademark, patent, trade secret, moral rights, publicity rights, privacy rights)
  4. Violate any contractual obligations You owe to third parties (e.g., non-disclosure agreements, exclusive licensing agreements)
  5. Contain unlicensed music, images, video clips, or other copyrighted materials unless You have explicit permission or the User Content falls under fair use/fair dealing exceptions (which You must be able to prove);
  6. Compliance: Your User Content complies with all applicable laws, regulations, and these Terms (including Section 12);
  7. Accuracy: All information You provide in connection with Your User Content is accurate, truthful, and not misleading;
  8. Third-Party Content: If You import or use third-party content in Your videos (e.g., music from external sources, stock footage from other platforms, celebrity images), You are solely responsible for ensuring You have the legal right to use such content. Mojo's music library is licensed; external content is Your responsibility.
  9. Indemnification

You agree to indemnify, and hold harmless Dailymotion Inc. and its Affiliates, and its respective officers, directors, employees, agents, licensors, and service providers from and against any and all claims,

liabilities, damages (including punitive damages), losses, settlement payments, costs, expenses, and fees (including reasonable attorneys' fees and court costs) arising out of or related to:

  1. Any breach of these Terms by You;
  2. Any violation of applicable law by You;
  3. Any infringement or misappropriation of any intellectual property or other rights of any third party by Your User Content;
  4. Any claim that Your User Content caused harm to a third party;
  5. Your use of the Service in a negligent or wrongful manner.
  6. INTELLECTUAL PROPERTYMojo's Exclusive Ownership

All elements of the Mojo Service are protected by intellectual property rights (copyrights, trademarks, patents, designs, trade secrets) and belong exclusively to Dailymotion Inc. and/or its Affiliates and/or its licensors.

Protected elements include:

  1. Source code and application architecture
  2. Graphical interface, design, animations
  3. Templates (video models)
  4. Effects, filters, transitions
  5. Fonts
  6. Logos, trademarks, trade names
  7. Documentation, tutorials, FAQ

Any unauthorized reproduction, representation, modification, or distribution of these elements constitutes infringement subject to civil and criminal sanctions.

  1. License Granted to User

By accessing the Service, Mojo grants You a license to use Service elements, under the following terms: License nature:

  • Personal: for Your use only (except extended license for businesses - contact us)
  • Non-exclusive: we grant the same license to all users
  • Non-transferable: You cannot resell or assign it
  • Revocable: it ends if You violate these Terms or upon Account closure
  • Time-limited: duration of Your subscription (for Pro features) This license allows You ONLY to:
  • Use the application in accordance with its intended purpose (create videos)
  • Use provided templates, effects, fonts to create Your own User Content
  • Export and retain final videos You create
  • Publish Your creations on Your social networks, website, etc. This license does NOT allow You to:
  • Extract and separately use Mojo elements (templates, effects, fonts, music) outside the application
  • Resell or redistribute templates, effects, fonts, or music
  • Create derivative works from Mojo elements to distribute them separately
  • Use Mojo elements to create a competing service
  • Copy, decompile, disassemble, or reverse engineer the application code
  • Remove intellectual property notices or watermark (Free version)
  1. Trademarks and Logos

"Mojo," "Archery,", “Dailymotion,” and any associated logos are registered or pending trademarks. Any use of these trademarks (in advertisements, communications, domain names, etc.) without our prior written authorization is prohibited.

If You wish to mention Mojo in an article, video, or communication, You may write the name "Mojo" in plain text but not reproduce the logo or use the trademark in a way that suggests an official partnership.

  1. Music License

Music tracks available in Mojo are provided under license by third-party music providers. Mojo does not own copyrights to this music. We act as sub-licensor: we transmit to You part of the rights we have obtained.

By using a music track in one of Your creations via Mojo, You benefit from a sub-license to integrate this music only in the final video created via the application.

This sub-license is non-exclusive, non-transferable, limited to use in Your Mojo creations, and conditional upon compliance with restrictions set forth below.

This sub-license ALLOWS You to:

  • Use the music track as part of Your final video;
  • Share, publish, and distribute Your final video (including the music) on social networks, websites, and other platforms;
  • Use Your final video for commercial purposes (e.g. marketing, social media advertising, corporate communications).

This sub-license DOES NOT include the right to:

  • Extract, download, or use any music track separately from Your final video;
  • Sublicense, resell, or redistribute any music track as a standalone file;
  • Use any music track in a TV broadcast, commercial film, television or radio advertisement, in- theater advertisement, video on demand (VOD), or any DVD, CD, or video game sold to the public.

This sub-license terminates if Your subscription ends or if You violate these Terms. However, final videos already exported and published before termination may continue to be used.

  1. Platform copyright claims and Content ID

IMPORTANT NOTICE: Although the music in Mojo's library is licensed through third-party providers and legally cleared for use in Your videos created within the app, automated copyright detection systems on third-party platforms (YouTube Content ID, Facebook Rights Manager, Instagram Audio Matching) may still flag or claim Your videos.

This occurs because:

  • These platforms' algorithms match audio fingerprints automatically
  • Rights holders may have registered the same tracks on multiple platforms
  • Our license does NOT automatically whitelist Your videos on third-party platforms If Your video is claimed or blocked:

  1. USAGE RULES AND AI-POWERED CONTENT FILTERINGProhibited User Content and Conduct

You must NOT create, upload, share, or publish User Content:

  • Violates laws or third-party rights (copyright infringement, defamation, privacy violations)
  • Contains illegal material (CSAM, terrorism, drug trafficking, fraud)
  • Is pornographic, sexually explicit, or sexually exploits minors
  • Depicts graphic violence, promotes self-harm, or incites hatred/discrimination
  • Constitutes spam, malware, phishing, or deceptive practices
  • Involves harassment, impersonation, or attempts to circumvent security systems
  1. AI Prompt Filtering

Our AI tools use automated filters that analyze Your text/media inputs before User Content generation. If Your Prompt violates our policies (violence, explicit, hate speech, illegal activity):

  • The generation is blocked immediately with an error message
  • No Credit is consumed
  • No human review occurs (unless the Prompt indicates imminent serious harm)

Important: Filters may occasionally block legitimate Prompts (false positives) or miss violations (false negatives). If blocked in error, rephrase Your Prompt or contact feedback@mojo.video.

  1. Your Responsibility

You are solely responsible for:

  • Ensuring Your User Content complies with these Terms and all laws;
  • Obtaining necessary rights/licenses before using third-party User Content;
  • Reviewing AI-generated Content before any use, including commercial use, publication, distribution or export.

Important: Our AI filters are designed to prevent obvious policy violations but cannot guarantee that all AI-generated content will comply with applicable laws or third-party rights. It is NOT a substitute for Your judgment or legal due diligence.

  1. LIABILITY AND SERVICE AVAILABILITY

Nothing in these Terms shall exclude or limit any statutory rights that You, as a Consumer, are legally entitled to under applicable law, which cannot be contractually waived or altered. This includes, but is not limited to, the legal warranty of conformity for digital content and services (two years under French and European Union law), the warranty against hidden defects, liability for death or personal injury caused by our negligence, and liability for fraud or fraudulent misrepresentation.

  1. Service Provision and Availability
  2. Best Efforts Obligation

Mojo is subject to a best-efforts obligation regarding Service provision. This means We will use commercially reasonable efforts to ensure quality and availability of the Service, maintain security of Your data, correct bugs and defects within a reasonable timeframe, and provide necessary updates, including security updates.

However, We do not guarantee:

  • uninterrupted or error-free operation;
  • that the Service will meet all Your specific requirements or achieve specific intended results;
  • absolute accuracy or completeness of all information provided through the Service, including AI- generated content;
  • compatibility with all devices or operating systems.

We shall not be held liable for any malfunctions inherent to the nature of the Internet or mobile networks, any Service interruption due to third-party operators (hosting provider, Apple, Google, telecom operators) over which We have no control, or any default caused by force majeure or an unintentional cause.

13.1.2 Service Availability

We aim for maximum Service availability, but we do not guarantee uninterrupted operation (outages may occur), error-free (bugs possible despite testing), or permanently accessible (maintenance necessary).

Where reasonably possible, We will provide advance notice of scheduled maintenance. Emergency maintenance may be conducted without prior notice if necessary for security purposes or to implement critical fixes.

Possible interruptions:

  • Scheduled maintenance: prior notification via application or email (generally at night)
  • Emergency maintenance: without notice if necessary (critical bug correction, security breach)
  • Force majeure: natural disaster, major internet infrastructure failure, DDoS attack, etc.

For paid subscribers, prolonged unavailability that prevents normal use of the Service may entitle You to a pro-rata refund in accordance with the provisions set forth elsewhere in these Terms.

  1. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: MOJO AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, business opportunities, or expected savings
  • Loss of data (if You failed to maintain backups as required in section 13.3)
  • Loss of goodwill or reputation
  • Cost of procuring substitute services
  • Business interruption or downtime
  • Any other indirect losses This exclusion applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if Mojo has been advised of the possibility of such damages.

For Consumer Users: Our aggregate liability for all claims shall not exceed the greater of: (a) The amounts You paid to Mojo in the 12 months preceding the claim, OR (b) One hundred euros (€100).

For Professional Users: Our aggregate liability is limited to the amounts paid by You to Mojo in the 12 months preceding the claim.

These limitations do not apply to:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be excluded under applicable law

If You are a consumer in the European Union, European Economic Area, United Kingdom, or Switzerland, You retain all mandatory statutory rights that cannot be contractually waived under applicable consumer protection law, including but not limited to the legal warranty of conformity (2-year period under Directive 2011/83/EU and national implementations) and the warranty against hidden defects. Nothing in this section affects such mandatory rights. If there is any conflict between this limitation clause and Your statutory rights, Your statutory rights prevail to the extent of the conflict.

  1. User Responsibility

You are responsible for maintaining regular backups of your User Content by exporting your creations regularly outside of the Service, maintaining the security of your Account credentials and preventing unauthorized access, ensuring compliance with all usage restrictions set forth in these Terms including music licensing requirements, and any harm caused to Mojo or third parties resulting from your violations of these Terms.

Your indemnification obligations are set forth in Section 10.5.

  1. Insurance

We have taken out professional liability insurance covering risks related to its activity.

  1. APPLICABLE LAW AND JURISDICTIONApplicable Law

These Terms of Use and any disputes arising out of or related to them or the Service shall be governed by and construed in accordance with:

  • For users residing in the European Economic Area (EEA), United Kingdom, and Switzerland: FRENCH LAW, without regard to its conflict of law provisions.
  • For users residing in the United States: THE LAWS OF THE STATE OF NEW YORK, without regard to its conflict of law provisions.
  • For users residing in other jurisdictions: FRENCH LAW, without regard to its conflict of law provisions.
  1. Jurisdiction

For Consumer Users in the European Union: You may bring legal proceedings in EITHER:

  1. The courts of Your habitual residence (where You live); OR
  2. The courts of Paris, France (Mojo's registered office)

Mojo may only bring legal proceedings against You in the courts of Your habitual residence.

For Professional/Business Users (all jurisdictions): Exclusive jurisdiction: COMMERCIAL COURT OF PARIS (Tribunal de commerce de Paris), France, or, for US-based professional users, state and federal courts located in NEW YORK COUNTY, NEW YORK.

For Users Outside EU/US: Disputes shall be submitted to the courts located in the NEW YORK COUNTY, NEW YORK except where mandatory local consumer protection law provides otherwise.

  1. GENERAL PROVISIONS / MISCELLANEOUSEntire Agreement

These Terms of Use, together with our Privacy Policy and any applicable Specific Terms, constitute the entire agreement between You and Mojo regarding use of the Service and supersede all prior or

contemporaneous communications, proposals, agreements, or representations, whether oral, written, or electronic, between You and Mojo with respect to the Service.

No purchase order, supplementary terms, or other documents submitted by You shall modify, amend, or supplement these Terms unless expressly agreed to in writing by an authorized representative of Mojo.

  1. Duration of these Terms

These Terms apply for as long as you use the Service in any manner, including creating an account, using Mojo Free, subscribing to paid plans, or accessing any features of the Service, whether you actively use the Service regularly or not.

For clarity, the following activities constitute "use of the Service" and are subject to these Terms: accessing the application, creating or editing projects, exporting videos, browsing templates or music, maintaining an active account (even if inactive), and accessing your account settings or profile.

  1. Assignment of Contract

You may not assign or transfer Your rights and obligations under these Terms to a third party without Mojo's prior written consent.

Mojo may freely assign all or part of its rights and obligations under these Terms to an affiliated or related company, successor, or acquirer (in case of merger, acquisition, asset transfer). You will be notified of any assignment with 30 days prior notice via email.

  1. Independence of Parties

These Terms create no relationship of subordination, representation, agency, partnership, or joint venture between You and Mojo. You and Mojo remain independent parties.

  1. Third-Party App Stores

If you access the Service via the Apple App Store or Google Play Store, the following applies: These Terms are an agreement between you and Mojo only. Apple and Google are not parties to these Terms and have no obligation or liability concerning the Service. All claims related to the Service must be directed to Mojo, not to Apple or Google. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

  1. Force Majeure

Mojo cannot be held liable for delay or non-performance of its obligations resulting from force majeure within the meaning of Section 1218 of the French Civil Code, including natural disaster, major and widespread power or telecommunications outage, large-scale cyberattack, act of terrorism, war, riot, widespread strike, major internet infrastructure failure, public authority decision, or pandemic.

In case of Force Majeure: temporary suspension of Mojo's obligations during duration of impediment, notification as soon as possible. If Force Majeure lasts more than 3 months, each party may terminate the contract without compensation, with pro-rata refund for current subscriptions.

  1. No Waiver

Mojo's failure or delay in exercising any right, power, or privilege under these Terms, or our decision not to enforce any provision of these Terms on one or more occasions, shall not operate as a waiver of such right, power, or privilege, nor shall it preclude us from exercising or enforcing such provision at a later time.

No single or partial exercise of any right, power, or privilege shall preclude any other or further exercise thereof, or the exercise of any other right, power, or privilege.

  1. Evidence

You acknowledge and accept that computer data retained by Mojo (logs, metadata, history) have evidentiary value, Mojo's recording and timestamping systems are presumed valid until proven otherwise, and emails, notifications, and screenshots may constitute admissible evidence.

  1. Prior Versions of Terms

Mojo maintains a history of prior versions of these Terms of Use.

  1. Export Control and Sanctions Compliance

You represent and warrant that:

  1. You are not located in, under the control of, or a national or resident of any country subject to comprehensive trade sanctions by the United States, European Union, United Kingdom, or France (including but not limited to Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine);
  2. You are not identified on any government list of prohibited or restricted parties, including the U.S. Treasury Department's Specially Designated Nationals List, the U.S. Commerce Department's Denied Persons List, Entity List, or Unverified List, or any equivalent EU or UN sanctions lists;
  3. You will comply with all applicable export control laws and regulations.

Mojo reserves the right to immediately suspend or terminate Your Account without notice or refund if You are found to be in violation of these representations or if We are required to do so by law or sanctions regulations.
